For mediation to start we need everyone to agree to join the process, but once that happens, we can start the process straight away. We can even approach the people you would like to join the mediation, if you like. 

There may be certain practical limits, but if people in dispute are willing to address their problems, Move On Mediation will do what we can to help, whenever and wherever practicable. That may be day, night, weekends or evenings. Whatever works for everyone. 

The flexibility of a Move On Mediation means it can be conducted as soon as a problem arises or even moments before a court is about to pass a final judgment on a matter. You can even invite people to mediation before a problem or dispute arises, so you can try to avoid getting into a dispute in the first place. 

The law in England and Wales requires people to consider alternative ways to resolve their disagreements without going to court, such as mediation. Now the court can even order disputing parties to do so. Court proceedings must be a last resort, and judges don’t like it if people don’t truly try to solve their problems themselves. Anyone that unreasonably refuses to try to resolve disputes out of court can be punished with high costs.

What’s more, anyone that starts court proceedings must keep considering whether they can resolve matters in a manner that doesn’t involve the courts.

Mediation can also be used when a dispute has been resolved, to ensure the previously disputing parties keep to their agreements, foster effective relationships and avoid getting into a dispute in the future.
